Andrea Sempio, a 37-year-old man under investigation for the murder of Chiara Poggi, was released after about an hour from his entry into the Montebello Barracks in Milan, where he had entered at 9:30 to undergo a DNA test (after refusing to do so voluntarily) ordered by the judicial authority. Surrounded by journalists, Sempio did not make any statements and was escorted with difficulty by the carabinieri to a taxi.

Following him, his lawyer, Massimo Lovati, briefly stopped to answer journalists’ questions, appearing annoyed by the inquiries. In particular, he disparaged the comparison of old evidence, repeatedly responding, “what evidence? There is no evidence,” explaining that today Sempio underwent a salivary test without any other actions: “The fingerprints were taken last time.”
“The 2017 investigation was a setup, it was the result of a setup by the defense” added Lovati.
The receipt kept for a year by Sempio “old stuff,” the calls to Poggi’s home “to find his brother, his friend,” and the refusal to voluntarily undergo the DNA test “to have an order from the judge, a third-party judgment.” Massimo Lovati spoke openly, the lawyer of Sempio.
“He did not voluntarily undergo the test – he stated – because we wanted an order from the judge, a third party.” And “there was no relationship with Chiara Poggi, he called Poggi’s house to find his friend.” Did he not know then – he was asked – that he had left? “Apparently not.”
About the receipt kept for a year, he snapped: “But it’s all outdated stuff, things already archived, all outdated.” Finally, he also clarified his thoughts on the “setup”: “The investigation was a setup organized by the investigators of Stasi’s defense lawyers, who secretly took his DNA.”
In the new investigation by the Public Prosecutor’s Office in Pavia, the Carabinieri of the Investigative Unit in Milan will reanalyze all the traces found to develop those overlooked in the investigation for which Alberto Stasi is serving 16 years in prison. Since the identified traces, particularly at the crime scene, are multiple, it is hypothesized that more “unknowns” will emerge. Furthermore, the second DNA profile found years ago on Chiara’s nails, which could not be profiled then, will be developed.
Meanwhile, the Carabinieri have listened not only to Marco’s brother but also to other friends of the group Andrea Sempio belonged to. Marco Poggi, as reported by newspapers, was heard yesterday. It is learned that the investigators went to his home in Pavia, where the man lives. As part of the investigations, some of those who were part of Marco Poggi and Andrea Sempio’s group at the time of the crime, who also knew the victim, have already been heard. All those who were previously questioned will be called back.

The DNA examination of Sempio is repeatable. Doubts about the possible motive
It will not happen in the confrontation between the parties and, therefore, at the moment it is classified as a repeatable verification, the examination on the DNA extracted from the swab that Andrea Sempio underwent today, again investigated by the Public Prosecutor’s Office in Pavia for the murder of Chiara Poggi in complicity with Alberto Stasi, already sentenced to 16 years in prison, and other unknown individuals.
The fact that it is a repeatable examination suggests, as explained by experts, that a technical consultation by the defense will be carried out, i.e., by the prosecutors, and that Sempio’s DNA will be compared with the old data. Data dating back to the time of the expertise ordered in the second appeal trial against Stasi in an attempt, then considered impossible, to identify to whom the two genetic profiles found on the edges of Chiara’s nails belonged.
If, instead, the comparison were to be made with potential biological material preserved without the knowledge of the parties – it is reported from judicial documents that it was used and depleted during the expert examinations – it will be necessary not only to document the preservation and how it occurred over these 18 years but also to carry out an irreplicable verification and therefore in the presence of consultants from both the defense and the civil party.
Any presence of genetic traces attributable to Andrea Sempio on Chiara’s nails will have to overcome some obstacles already noted by the magistrates who dealt with the initial investigation against Marco Poggi’s friend, including the potential relevance of those traces as a unique circumstantial element.
A topic already addressed and negatively resolved by the Pavia gip Fabio Lambertucci in 2017 in the first archive order. “Traces of Sempio’s DNA – the judge wrote – could well have ended up on Chiara’s nails indirectly because both used a desktop computer in Poggi’s house that Chiara’s brother and his friends often used to play video games controlled by a keyboard.”
Another issue is the motive, which has not been “identified” even “assuming the boy had feelings” for Chiara. A claim also denied by Marco’s brother, who, even then, explained that Sempio “never asked anything” about his older sister.
“There were seven years of difference, so we hung out with completely different groups.”
Stasi’s Lawyer: ‘Serious to talk about a setup’
“I just heard someone defending their client saying, ‘I hope this is not another setup’, referring to the Public Prosecutor’s Office.” These were the words of Alberto Stasi’s defense lawyer, Antonio De Rensis, a guest on Mattino Cinque News, a program on Canale 5 hosted by Federica Panicucci and Francesco Vecchi.
The lawyer responded live to the statements of his colleague Massimo Lovati, the defense lawyer of Andrea Sempio, who, after Sempio’s DNA was collected at the Montebello Barracks in Milan, mentioned a “setup.”
“These words are music to my ears – said lawyer De Rensis – I don’t want to criticize unnecessarily. I just hope that one day he says that it’s our setup, I’m not interested in what the previous lawyers said, but above all, I hope that these statements reach the Public Prosecutor’s Office soon, because this is a very serious accusation.”
