    Kevin Pittuck-Bennett, residente a Chelmsford, ha fatto della sua esperienza nel settore pubblicitario un modo per mettere a disposizione il suo know-how, la sua telecamera e il suo entusiasmo per la surrogata “solidale”. In Regno Unito è vietato lucrare sulla gestazione per conto terzi, ma chiamare i pagamenti “rimborso spese” è consentito.

    A 46 anni, 8 in più del marito Michael, hanno avuto Peggy nel 2024 grazie a una madre “altruistica” e ora vogliono condividere la loro esperienza con altri genitori in cerca di soluzioni alternative.

    “La maternità surrogata ci ha resi umili”

    “È un processo che ci ha resi umili”, spiega Pittuck-Bennett in un’intervista alla Bbc. Ha deciso di documentare l’attesa di Peggy su un canale YouTube per aiutare altri genitori in un percorso simile. “Ci sono state tante emozioni a cui non eravamo preparati. L’etica della maternità surrogata è basata sull’amicizia prima di tutto.”

    Secondo la Bbc, il numero di “parental order” in Inghilterra e Galles è aumentato significativamente negli ultimi anni, indicando un interesse crescente per la surrogata. Ci sono stati casi di uomini single over 50 che cercano un figlio tramite surrogata, dimostrando che l’opzione è sempre più diffusa.

    La guida per conquistare le surrogate solidali, “hanno loro il potere”

    Nella sua guida, Pittuck-Bennett spiega i fondamentali per connettersi con la madre surrogata e avere successo nel processo. “Devi risultare attraente per le donne che vogliono fare questa cosa meravigliosa per te. Il potere è nelle mani della madre surrogata e devi sperare che scelga te”, racconta. Nonostante possa sembrare strano, la solidarietà è alla base di questo processo.

    Nonostante le controversie, nel Regno Unito i genitori che ricorrono alla surrogata all’estero non vengono negati i diritti genitoriali, dimostrando che l’approccio alla surrogata è in continua evoluzione.

    Il caso delle due madri più che settantenni

    Un caso particolare ha coinvolto due madri “completamente egocentriche” che hanno fatto scalpore nell’Alta Corte. Il giudice ha reso pubblica la sentenza come monito per altri, evidenziando le problematiche legate alla surrogata.

    Un’altra storia ha coinvolto due donne che hanno scoperto di aver commissionato la maternità surrogata in un luogo illegale, con conseguenze inaspettate. Questi casi mettono in evidenza le sfide legate alla surrogata e l’importanza di una regolamentazione chiara.

    Not only did Mrs. X visit the registry office to sign a form in an unknown language (presumably Turkish) at the clinic’s encouragement, which she later found out automatically made her the mother of both children. There was no mention of the surrogacy agreement (the clinic never provided any documentation to confirm it) or the fact that the children were born to two different mothers.

    Surrogates Gone Missing, Court Decides on “Stateless” Children

    It became clear that being born in Northern Cyprus did not automatically grant the children citizenship in Northern Cyprus. Similarly, being born to a Ukrainian citizen did not automatically give them Ukrainian nationality. Furthermore, there was no legal link that attributed them a recognized status in the UK in relation to the applicants (birth certificates had been issued on incorrect grounds).

    It took four years for the first-instance court to grant the women’s application for entry into the UK under Article 8 of the European Convention on Human Rights. Without genetic ties, the women applied for adoption of the two “stateless” children, a request that was only granted after a long legal battle. The decision was made following the minors’ guardian’s assessments and in the absence of information on the Ukrainian surrogate mothers, never provided by the clinic.

    The judge’s ruling emphasized the concerns over the circumstances surrounding the birth of these two children, indicating that all four women involved in the agreements were likely exploited for profit. The judge expressed concerns over the selfishness of prospective parents in their 60s, highlighting the long-term impact on the children’s welfare. The judge also warned of potential future cases where adoption orders might be opposed, leaving the child stateless and legally parentless.

    The court’s decision on February 19 made headlines on March 1, with Damian and Pasan Fernando sharing their struggles to bring their twins born via a surrogate in Cyprus back to the UK. Document issues and delays have prevented them from reuniting with their children, leading to emotional distress and financial strain.
